Terms & Conditions

These Terms and Conditions ("Agreement") govern the services provided by Monster Sites ("Service Provider," "we," "us," or "our") to the customer ("Client," "you," or "your"). By engaging in our services, you agree to the following terms:

1. Services Provided

Monster Sites provides website design, development, and hosting services on the Wix platform. The scope of services may include, but is not limited to:

Website design and development
Customizing Wix templates
Hosting services through our Wix account
Website content updates and maintenance
SEO setup (Search Engine Optimization)
Integration of third-party applications

All websites are hosted under Monster Sites’ Wix account, with the Client retaining ownership of their content and intellectual property.

2. Client Responsibilities

Content and Materials: The Client is responsible for providing accurate and timely content (such as text, images, logos, etc.) to be used on their website. The Client is also responsible for ensuring all content complies with applicable copyright laws. Monster Sites is not liable for any legal issues arising from the use of copyrighted or unlicensed content supplied by the Client.
Review and Approval: It is the Client’s responsibility to review the website before it goes live. Once the website has been approved by the Client, any additional changes will be billed separately.
Domain Management: While Monster Sites can assist with connecting domains to the Wix platform, the Client is responsible for purchasing and maintaining their domain names, unless otherwise agreed in writing.

3. Service Provider Responsibilities

Website Design and Development: Monster Sites will provide design and development services as outlined in the agreed-upon project scope.
Hosting: Websites are hosted under Monster Sites’ Wix account. We will manage the hosting, including uptime, renewals, and other related services. However, as Wix is a third-party platform, we cannot guarantee uninterrupted service.
Wix Platform Limitations: The Client acknowledges that Monster Sites operates on the Wix platform, and therefore, certain customizations or features may be limited by the platform’s capabilities. Monster Sites is not responsible for any limitations, downtimes, or errors caused by Wix or third-party integrations.

4. Hosting and Platform-Related Issues

Wix Platform: Monster Sites hosts Client websites through Wix, a third-party platform. As such, we do not have control over Wix's performance, uptime, or potential downtime. Any disruptions in service due to Wix outages, system failures, or platform issues are outside of Monster Sites' control, and we are not liable for losses or damages arising from such incidents.
Third-Party Integrations: If the Client uses third-party apps, widgets, or integrations on their website, Monster Sites is not liable for any performance issues or disruptions caused by those services.
Hosting Transfer: If the Client wishes to transfer the hosting of their website to a personal Wix account or another platform, Monster Sites will facilitate the transfer. However, any additional costs associated with transferring or setting up a new hosting environment will be the responsibility of the Client.

5. Liability Limitation

Platform and Hosting Issues: Monster Sites is not liable for any issues related to the performance, downtime, or security of the Wix platform. Any service interruptions, hosting-related issues, or other problems due to Wix must be addressed directly with Wix.
Errors and Mistakes: While we strive to deliver error-free websites, Monster Sites cannot guarantee that the website will be free from errors. In the event of a mistake or error that directly results in a financial loss to the Client, our liability will be limited to the total amount paid for the services provided by Monster Sites.
Indirect or Consequential Loss: Monster Sites is not liable for any indirect, incidental, or consequential losses (e.g., loss of revenue, business interruption, reputational damage) arising from the use or performance of the website or hosting services.

6. Payments and Fees

Payment Terms: Payment schedules will be outlined in the project proposal. Unless otherwise stated, a non-refundable deposit of 50% is required before any work begins. The remaining balance is due upon project completion and prior to the website going live.
Hosting Fees: Hosting fees for websites managed under Monster Sites’ Wix account will be billed on a [monthly/annual] basis. These fees cover the cost of hosting services, including storage and bandwidth, and will be outlined in the Client’s agreement.
Additional Services: Any work outside the agreed project scope, including additional design revisions, changes requested after project approval, or new features, will be billed at our standard hourly rate of £55 or as otherwise agreed.

7. Ownership and Intellectual Property

Client Ownership: The Client retains full ownership of all intellectual property rights (including content, images, and branding) provided for the website. Upon completion of the project and final payment, the Client also retains ownership of the website design and custom graphics created by Monster Sites.
Hosting and Platform Ownership: The website is hosted under Monster Sites’ Wix account. While the Client owns the website content and design, Monster Sites maintains control over the hosting environment. If the Client wishes to move the website to their own Wix account, we will assist in the transfer process.
Third-Party Content: Any third-party plugins, widgets, or content used on the Wix platform remain under the ownership and control of their respective owners. The Client must comply with any licenses or usage terms of such third-party content.

8. Termination

Client Termination: The Client may terminate this Agreement at any time by providing written notice. Any work completed prior to termination will be invoiced accordingly. Deposits are non-refundable, and hosting fees paid in advance are non-refundable.
Service Provider Termination: Monster Sites reserves the right to terminate the Agreement if the Client fails to make payments, does not provide the necessary information for project completion, or breaches any of these terms.
Termination of Hosting: If either party terminates this Agreement, the Client is responsible for migrating their website to another hosting account or platform. Monster Sites will assist with the transfer, but additional fees may apply.

9. Indemnification

The Client agrees to indemnify, defend, and hold harmless Monster Sites from any claims, damages, liabilities, or expenses (including legal fees) arising from:

The Client’s use of the website and hosting services
Any copyright, trademark, or intellectual property infringement claims related to content provided by the Client
Any breach of this Agreement by the Client

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from this Agreement will be resolved in the courts of the United Kingdom.

11. Amendments

Monster Sites reserves the right to update or amend these Terms and Conditions at any time. The latest version will be made available here on our website or upon request. Continued use of our services after any amendments constitutes acceptance of the updated terms.

12. Acceptance of Terms

By engaging in our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
