Terms OF BUSINESS

The Legal Bit

Please read these Terms and Conditions carefully before proceeding with your website purchase. By paying the deposit to Monster Sites, you confirm that you have read, understood, and agree to be bound by these terms.

1. PartiesThese Terms and Conditions ("Agreement") are entered into between:Monster Sites ("we", "us", "the Company") — the website design and hosting provider; andThe Client ("you", "the Customer") — the individual or business purchasing the website and hosting services.2. ServicesMonster Sites agrees to provide the following services under this Agreement:Design and development of a website as agreed between both parties prior to commencementOngoing website hosting services following the launch of the completed websiteBasic technical support in relation to the hosting environmentThe scope of the website design will be agreed separately and any significant changes to the agreed scope may be subject to additional charges.3. Payment Terms3.1 Initial DepositA non-refundable deposit of £250 is due prior to commencement of any design or development work. Payment of this deposit constitutes acceptance of these Terms and Conditions and confirms your instruction for Monster Sites to begin work.3.2 Monthly Hosting FeeFollowing the launch of your website, a monthly hosting fee of £25 per month will be due. This fee covers:Website hosting on our serversDomain name management (where applicable)Basic server maintenance and security updatesThe first monthly payment will be due on the date your website goes live, and on the same date each subsequent month.3.3 Payment MethodMonthly hosting fees will be collected by the payment method agreed at the time of purchase. It is your responsibility to ensure payment details remain current and valid.3.4 Late PaymentIf any monthly payment is not received within 14 days of the due date, Monster Sites reserves the right to suspend hosting services until the outstanding balance is settled. In the event of continued non-payment beyond 30 days, we reserve the right to terminate the hosting agreement and take the website offline.4. Website Design & DeliveryWe will use reasonable endeavours to deliver the completed website within the timescale agreed at the outset. Timescales are estimates only and may be affected by delays in receiving content, feedback, or approvals from the Client.You are responsible for supplying all required content, images, text, and other materials in a timely manner. Monster Sites will not be held responsible for delays caused by the Client.Once the completed website is presented to you, you will have a reasonable opportunity to request minor revisions. Significant changes to the original agreed scope may be subject to additional charges.5. Intellectual PropertyUpon receipt of the initial deposit and any outstanding final payment, the design and visual elements of the website created by Monster Sites will become the property of the Client.Any third-party assets, plugins, themes, or software used in the build remain subject to their respective licences. Monster Sites makes no warranty regarding the ongoing licence terms of any third-party components.Monster Sites reserves the right to display the completed website as part of its portfolio, unless the Client expressly requests otherwise in writing.6. Hosting & UptimeMonster Sites will make reasonable efforts to maintain website uptime and server availability. However, we do not guarantee 100% uninterrupted service. Scheduled maintenance, third-party infrastructure issues, or circumstances beyond our control may occasionally result in downtime.Monster Sites will not be liable for any loss of business, revenue, or data arising from unplanned downtime.7. Client ResponsibilitiesAs the Client, you agree to:Provide accurate and complete information when requestedEnsure all content supplied to Monster Sites is lawful, does not infringe third-party rights, and does not contain material that is defamatory, offensive, or otherwise unlawfulKeep your account and payment details up to dateNot attempt to access, modify, or interfere with the hosting environment or server infrastructure8. Cancellation8.1 Cancellation by the ClientYou may cancel the monthly hosting service by providing a minimum of 30 days’ written notice to Monster Sites. No refund will be given for any part of the current monthly billing period already paid.The initial £250 deposit is non-refundable under any circumstances, including cancellation prior to the completion of the website.8.2 Cancellation by Monster SitesMonster Sites reserves the right to terminate this Agreement and/or hosting services with 30 days’ written notice for any reason, or immediately in cases of breach of these terms, non-payment, or unlawful use of our services.In the event that Monster Sites terminates services without cause, a pro-rata refund of any prepaid hosting fees will be provided.9. Limitation of LiabilityTo the fullest extent permitted by law, Monster Sites’ total liability to you in connection with this Agreement shall not exceed the total amount paid by you to Monster Sites in the 12 months preceding the claim.Monster Sites shall not be liable for any indirect, consequential, or special loss, including (without limitation) loss of profits, loss of data, or loss of business opportunity.10. Data ProtectionMonster Sites will handle any personal data provided by you in accordance with applicable UK data protection law, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our Privacy Policy, available on request, sets out how we collect, use, and protect your data.11. Changes to These TermsMonster Sites reserves the right to update these Terms and Conditions from time to time. We will provide you with reasonable written notice of any material changes. Continued use of our hosting services following such notice constitutes acceptance of the revised terms.12. Governing LawThis Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.13. Entire AgreementThese Terms and Conditions, together with any written proposal or scope document agreed between the parties, constitute the entire agreement between Monster Sites and the Client and supersede any prior discussions, representations, or agreements.14. AcceptanceBy paying the initial deposit of £250 to Monster Sites, you confirm that you have read, understood, and agree to these Terms and Conditions.
